Human Rights Violation

Violation of human rights is not a strange matter to the global people. But, you are a human being with the real heart and sympathy solely, you must feel the inhuman acts occurring through the world. Let us discuss on what types of violation are seen. We see most of the people are deprived of basic human necessities. Besides, due to racial discrimination, fundamentalism, communal discrimination, we can see that minority of different countries are facing oppression and suppression.

The worst sufferers are women and children.
Dowry, child labor, child trafficking, early marriage, polygamy, sexual harass, rape, sentence to death are also the violation of human rights. Here I am going to discuss on the violation of human rights with a view to exposing the facts and findings to the conscious people to eliminate the social annoyance.
In third world countries, dowry is considered as a social curse. Being unable to give assets (large some of money motorcycle, television, refrigerator or any kinds of movable/unmovable assets), bridegrooms and their parents torture the brides. Consequently, many brides are compelled to commit suicide. Many brides are killed by their husbands.
Child labor is another social phenomenon which is commonly seen in the third world countries particularly in south Asia. All of the children come from poverty stricken family. They don't get proper food, shelter, treatment, clothes and education. Sometimes, kids are died when they are engaged in life risk works.
Child trafficking from south Asian countries is seen in the daily newspapers. Seeing trafficking news, human rights organizations come forward to aid the victims accordingly. Every year, kids are taken Middle East countries such as UAE, Oman, Katter, Bahrain, Saudi Arab and Sudan illegally from Bangladesh, India, Nepal, and Pakistan.
Early marriage is mostly found in Muslim communities in Asia, Middle East, Africa and Arab countries. As a citizen of Bangladesh, I have seen that lots of underage girls are forced to get married. For example, a 12 years old girl is wedded to a man of 60. As a social and religious custom it is allowed to permit these inhuman acts. In this civilized world, nobody will tolerate these.
Allowing polygamy in a society can bring a lot of miseries. Let me tell a true story of a Muslim woman who was in such a family. Her husband had 4 wives and he got inspiration morally and spiritually by following their prophet Muhammad who also had about 13 wives. However, the woman were deprived of all rights from her husband and she was compelled to do hard job outside home. Every night, being drunk, her husband would come and bit her severely while children were crying seeing the ferocious acts. At one point, the woman couldn't help committing suicide. This is the consequence of polygamous family.
Sexual harassment is also a human rights violation. Millions of girls of adolescences are being harassed or abused all over the world. At day light no one can be identified as a criminal who harass the girl sexually but in darkness man becomes a Hyena. He raped and killed the innocent girl. Thus girls are living without safety as hundreds of Hyenas roam here and there. How will we stop these Hyenas? How can we protect the girls? We must think of it.
Justice delayed, justices denied- this is the words that can make you a clear sense about the violation of human rights. What is the most important is to ensure justice without any delay. The remedy is something that is expected by all though we can't get any suitable remedy to eliminate all sorts of human right violation.

What is the Universal Declaration of Human Rights? - Know Your Rights

Do you know your rights under your constitution of the nation? Have you ever evaluated your rights? If not, how you will follow the legal course to address the problems arising? Very few countries are serious about promoting the right to education for people to help you know your rights. Have you tried to know that the right to good food and the right to basic education is covered in your Universal Declaration of Human Rights? Being a student of the Post-Graduate Diploma in Human Rights, have attempted to know your rights?
On December 10, 1948, the United Nations General Assembly adopted and proclaimed the Universal Declaration of Human Rights. It aims to promote respect for these rights and freedoms and their universal recognition and observance, both among the peoples of Member States themselves and among the peoples of territories under their jurisdiction. It is applicable to all UN member states, which are now almost all countries of the world. The Universal Declaration of Human Rights was not originally designed to be legally binding, but it became legally binding as customary law of the individual man. It lists the rights of your human beings in the world, called articles 30.

1 You are born free and equal and should act towards one another in a spirit of brotherhood
2 You can not be discriminated against based on race, color, sex, language, religion, political or social origin.

18. You have the right to freedom of thought, conscience and the right to religion.
19. You have the right to freedom of opinion and expression
20. You have the right to freedom of peaceful assembly and association
21. You have the right to Democracy
22. You have the right to social security.
23. You have the right to work, to free choice of employment and reasonable working conditions.
24. You have the right to rest and leisure
25. You have the universal right to adequate food and shelter.
26. You have the universal right to education. Education shall be free, at least in the elementary and fundamental
27. You have the right to participate in the cultural life of the community and the right to protection of moral and material interests.
28. You have the universal right to a fair trial and Free World
29. You have the right responsibility
30. All machines in the United Nations and Member States and their various acts of the judiciary is intended to work in the target set in the Universal Declaration of Human Rights, 1948.
Do you know how many people in the world are entitled to these rights? Do you know how those rights are accepted by the law of your country? Most UN member states have completed the paper required to accept these rights and to punish those who violate it. But the practical spirit is lacking, even in developed countries. Do you know that the empowerment of social justice is missing in the world? Large companies are exploiting your rights and cause an imbalance in the distribution of wealth and pollution of the global environment. Do you know that good food and housing is still denied to most people in the world? Do you know that the right to basic education is still denied to children in the world? Many are not even aware of this right.
Have you tried to know that the right to good food and accommodation is included in your Universal Declaration of Human Rights? Have you ever tried to know that the right to basic education is covered in your Universal Declaration of Human Rights? Have you ever tried to know that freedom of expression is within your rights? Have you ever tried to know that the right to freedom of thought, conscience and religion is included in your rights universal? Have you ever tried to know that you are fully aware and support the human rights of all human beings in the world? If human rights are followed with honesty, peace in human life in the world is already achieved? It is my perception

The Benefit of Human Rights

Human rights are such basic rights of a person that everyone should get a chance to be treated fairly and not to be discriminated on the basis of color, age, religion, gender or sex, ethnic or indigenous group, language, politics or caste. Human rights guarantee the fundamental right of the people. The most common fundamental rights are - Right to equality, Right to freedom or liberty, Right to press and publication, Right to criminal justice, Right against preventive detention, Right against exile, Right against exploitation, Right to property, Right to information, Right to religion, Right to culture and education, Right to privacy and Right to constitutional remedy.
In other words, human rights are those rights provided to us by us. So these are our natural rights. These rights always help a person to develop their personality. They help to uplift economic and social standard of a country although some may misuse human right. There are numerous human right organizations in the world that look after human rights. The UNO, Amnesty International and European Court of Human Rights are some world famous organizations.
In conclusion, human rights are those civil rights that we need to make our survival meaningful and significant. Human rights must be guaranteed to every person by the state whether that state is developed or developing so that there will be uniformity throughout the world. This will then only make the world a common standing ground for all and everyone could enjoy the basic human right no matter in what part of the globe they may reside on.

Human Rights Commission - How and Where to File Human Rights Complaints

What are human rights commissions in India and how they trained? What are the powers and functions of the Commission on Human Rights of the state and how it investigates complaints? What type of complaints is not accepted by the Commission on Human Rights? If you do not know it, how you will monitor your rights to your complaint, the Human Rights in India? Being a student of the Graduate Diploma in Human Rights, have attempted to summarize the strategy guide to file your complaint on the Rights of India.
Human rights are violated in India as in the world. Many people fail to distinguish between human rights and their grievances and others are addressed to courts to obtain justice for violations. The judiciary in India is slow and corrupt. Thus, many cases remain unattended for many years. In other cases, general litigation must be submitted to courts. But few people are aware that a complaint commission is simple, effective and fast way to get justice in India. Here's the strategy guide to file your complaint with the State commissions to cite an example in Chandigarh, Punjab.

Each Indian state has its own commissions established by the state government. It works in coordination with the National Commissions of Human Rights to comply with your rights under the Indian Constitution or embodied in the International Covenants and enforceable by the courts in India. Always approach the commissions directly to your complaint or initiate any direction without lawyers. In the case of commissions Punjab, its address is in Punjab Human Right Commission, SCO NO. 20-21 Sector 34A Chandigarh 160034, India. In the case of the woman, you can approach. Office of the State Commission for Women, Punjab SCO 57-59 Sector 17-C, Chandigarh.
What are the functions of the State Commissions?
The Punjab State Commission was established under the Protection of Human Rights Act 1993. It is composed of eligible persons composed of: a president who has been chief judge of the High Court. It includes a member who is or was a judge of the High Court to another member who is or has been a district judge. Two members appointed from among persons having knowledge or practical experience in the field of human rights.' The Punjab Women commission was created in July 1997 to care for women is the natural law.
For more information on its own initiative or on a petition presented to him by the victim or any other person on his behalf, on the complaint of violation of rights and negligence in preventing the violation by a public servant. Commission may intervene in proceedings concerning an alleged violation of human rights pending before a tribunal with court approval. It may, under intimation to the State Government, inspect prison or other institution under the control of state government, where persons are detained or lodged for purposes of treatment, the reform or the protection of study the living conditions of inmates and make recommendations.
Commission to examine the safeguards provided by or under the Constitution or any law currently in force for the protection and recommend measures for their effective implementation. Commission examines the factors, including acts of terrorism that inhibit the enjoyment of human rights and recommend appropriate corrective measures. It examines the treaties and other international instruments and makes recommendations for their effective implementation. It aims to disseminate literacy among various sections of society and promote awareness of the safeguards guaranteeing protection of these rights through publications, media, seminars and other means available.
What powers have been granted to the Punjab State Commission relating to inquiries?
While inquiring into complaints under the Protection of Human Rights Act 1993, the Commission shall have all the powers of a civil court trying a suit under the Code of Civil Procedure. It may examine them under oath and the discovery and production of any document, proof of delivery on affidavits, requisitioning any public record or copy of any court or board and fees for the issuance of the examination of witnesses or documents.
The Commission will investigate all complaints of violations of human rights may call for information or report from the Central Government or State Government or other authority or organization subordinate to it, within may be specified by it, provided that if the information or report is not received within the deadline set by the Commission may investigate the complaint on its own initiative; Moreover, if, upon receipt of information or report, the Commission is satisfied that no further inquiry is necessary or required actions have been taken or implemented by the government or the authority concerned, may proceed with the complaint and inform the complainant accordingly.
What measures are open to state Commission after investigation?
When the investigation discloses the commission of violations of human rights or negligence in preventing the violation of human rights by a public servant, he may recommend to the concerned Government or authority of the Opening the prosecution process or any other measure that the Commission thinks fit to the person or persons. He can go to the Supreme Court or the High Court for the departments concerned, orders or writs as that Court may deem necessary. It may recommend to the government concerned or the authority to grant such interim relief to the victim or members of his immediate family as the Commission deems necessary.
What type of complaints is not accepted by the State Commissions?
Commission can not inquire into any matter after the expiry of one year from the date on which the act constituting violation of human rights is alleged to have been committed. It can not investigate any matter which is pending before another committee duly constituted under the law for the time being in force. Commission does not address issues that are vague or anonymous. Commission does not address issues that are frivolous or trivial. It does not accept issues such as disputes between landlords and tenants, marital disputes, disputes relating to property inheritance, etc. Commission can not consider a violation of human rights by members of the Armed Forces in Central Europe. Commission can not know when the allegations are not against any government official of the State. Commission does not respond when the material is covered by a judicial verdict, the decision of the State Commission.
State Commissions in India are exempt from many elements of corruption in the regular court system. I recommend using his services in case of violation of human rights. It's quick, fair justice.

What Are the Basic Elements of International Human Rights Law?

International Human Rights law in one sense offers great promise and hope because of the lofty ideals which it espouses and in another sense great disappointment because of the gap between what these idealistic statements proscribe in terms of an aspiration for all mankind and the reality under which most people live. If all of the rights which are said to exist under the international human rights law project did actually exist, a global utopia would have come into existence. However all around the world, there are routinely breaches of the rights set out in the fundamental documents that proscribe what rights mankind is supposed to enjoy simply as a result of the fact that we are human.
The body of rights which is largely held to exist stems from three major documents which are said to the be the 'international bill of rights'. This is composed of the Universal Declaration of Human Rights (UDHR), the International Covenant on Civil and Political Rights (ICCPR) and the International Covenant on Economic Social and Cultural Rights (ICESR). These three conventions are said to represent in respective order first generation universal human rights, second generation universal human rights and the third generation universal human rights. Critics of the International human rights law project level their objections on the basis that the idea of universal rights if a western concept which is imposed without any sensitivity to the cultural practices of cultures which have developed independently of a rights based legal system. Although this is true in some respects, there are also human rights advocates within these cultures who accept the universality of the idea of human rights and say that often this intellectual objection to the notion of human rights is an excuse used to gloss over the numerous human rights atrocities committed by governments around the world. In any event, the global recognition of human rights has now existed for over 60 years in a codified international form and it appears unlikely that it will cease at any point in the near future as a relevant political discourse.

Human Rights in Ireland

Ireland is currently in a state of flux. The institutions of State, The Church and The Government and of course the Banks are all in a perilous state. People have lost faith in The Catholic Church and Fianna Fail and those who have lost money on bank shares are furious. We are in recession and people are losing their jobs. So who cares about human rights?
I do because I believe that how a country treats its weakest /most marginalised members of society is important. I could be down on my luck and I would like to know that I would be looked after. I want to know that I would get social welfare and a roof over my head. And I think that most people would be the same. I know that some people complain about those that are on the dole and call them lazy and opportunistic but a lot of decent people have lost their jobs through no fault of their own, but because they happened to be working in the construction industry and there is no work at the minute. Ireland, unlike the US has a good Social Welfare system.

The Irish Human Rights Centre in Galway has just brought out a report about Racism in the Taxi Industry and the author Vinod Jaichand has also pointed out that human rights are not just a luxury for the good times. Racism is a growing problem in Ireland and unfortunately organisations such as the National Consultative Committee to Combat Racism was disbanded in 2008. Just at a time when it is badly needed!
I am starting to think that the law is the only real remaining way of protecting citizens. After all the law is supposed to be by the people for the people. It is not enough to have laws on the Statute Books, these laws must also be enforced. It is an absolute disgrace that there was a Financial Regulator in place until 2008 who was either asleep on the job or persuaded by vested interests to turn a blind eye to what is going on in the economy. One of the best watchdogs at the minute is the Irish Human Rights Commission but unfortunately they have also had their budget cut by the Government.
Some of the current issues that were on the agenda at a recent conference between the Law Society of Ireland and the Human Rights Commission were
1) Business and Human Rights

2) Human Rights and the Environment

3) Lesbian Gay Bisexual and Transgendered People
Education is the way to address these issues. There is a problem in that almost all of the schools in Ireland are under religious patronage and this limits perspective and makes choices difficult for non-believers. Educate Together has done a lot of work in this area but that movement started with parents, not the Government, however they are now funded by the State. Travellers are not recognised by the State as an ethnic minority and because of this they may be losing out on EU protection of their identity and culture. Abortion is not freely available but the Government had their knuckles rapped last week by the European Court of Human Rights (Strasbourg) in relation of accessibility to doctors/medical care for women with crisis pregnancies.
In my view, the Irish Government is not proactive enough in relation to how it treats members of marginalised groups. Tension between different races can lead to violence as was seen recently by the death of a 15 year old schoolboy Toyosi Shittabey on Good Friday 2010. I can see the tragic irony in this, supposedly a Catholic Country. Racial tension must be addressed otherwise there will be more incidents of this nature. I always think it is wise to look ahead and see what is coming down the tracks towards us rather than burying our heads in the sand. Human Rights and Human Responsibilities belong to each and every one of us.

World Human Rights Day

Human Rights are universal and belong to everybody equally. The horrors with the Second Globe War shook the entire world! Apart from a huge number of precious lives lost, the world witnessed possibly probably the most gruesome violation of human rights during the time. In three years time, in 1948, the combined efforts of these nations paid off when the United Nations General Assembly adopted and proclaimed the "Universal Declaration of Human Rights" declaring that respect for human being rights and individual dignity "is the basis of independence, justice and peace in the planet."
The Globe Individual Privileges Day time is celebrated with gusto in New York City, the headquarters from the UN and across the planet. The working day is marked by high-level political conferences and meetings and cultural events and exhibitions with concentrate on problems. Much more importantly, it can be on this Day time how the five-yearly UN Prize in the Area of Individual Privileges and the coveted Noble Peace Prize are awarded. The notion of individual rights has numerous faces.

According towards the UN, human rights are interrelated, interdependent and indivisible legal rights inherent to all human being beings without discrimination and irrespective of our nationality, sex, nationwide or ethnic origin, color, religion, language, or any other status. All governments across the world countries are obliged to express, ensure and uphold the basic human legal rights in all its faces by means of laws in the forms of treaties, customary worldwide laws, and common principles along with other sources of worldwide laws.
While the core of the Universal Declaration has continued to remain the same that of safeguarding individual privileges wherever their violations happen, the social, political, economic and cultural modifications above the many years has created the must possess a flexible complete new network of instruments and mechanisms in place that is now being identified and developed to enforce the objective. The aim of this Declaration was to set basic minimum international standards for that safety from the rights and freedoms of the individual.
Freedom of speech, independence of press, freedom of religion, and the proper to bear arms, freedom from cruel and unusual punishment and the right to some fair trial and trial by jury are all are already recognized by the constitution. Equality in situation of race, gender, age, disability, and independence of religion, freedom of movement, freedom of expression, national safety exceptions, humane and humane treatment options, death penalty, prison program, wellness care and worldwide individual privileges are the matters which the United States may be criticized for not being able to serve the domestic and universal expectations.
Getting an essential right within the nation, religious flexibility is definitely a personal choice. Sadly, it is not so! Nowadays, the scenario is such that the religion determines the protection and liberty of a person. The government through its law enforcement agencies has to safe the liberty and privileges of persons. The media too has a successful part to play and not just confine to filming these atrocities on print and electronic media.
